Deporting People to Third Countries
In recent weeks, the Trump administration has moved aggressively to cancel thousands of asylum applications. Their argument is that they can deport people to third countries. In other words, the U.S. does not have to send an asylum applicant back to their home country—instead, any country the U.S. has an agreement with is sufficient.
The administration has made a push in immigration courts in many of the nation’s largest cities, including New York, Miami, Los Angeles, and Atlanta. But they continue to seek to cancel asylum across the country.
The Trump administration is seeking to have cases dismissed without any ruling on the merits. Their argument is that asylum seekers who fear persecution in their home countries can nonetheless be sent to a different country. Some popular destinations include Uganda, Guatemala, and Ecuador.
Data shows that ICE attorneys have sought to get more than 8,000 cases dismissed on these grounds. A decision from the Board of Immigration Appeals has directed immigration judges to consider whether the government can use a safe third country before deciding the asylum application on the merits. ICE lawyers file a “pretermit motion.”
Some asylum applicants are terrified of being deported to a country where they have no contact or associates. Some are even considering whether to withdraw their asylum application.
Deportation is not automatic. An applicant might show that they could face persecution in the “safe” third country. For example, some asylum applicants fear persecution for LGBT identity back home. But that type of discrimination or bias is rampant in all parts of the world. There might not be a safe third country where the U.S. can send you.
