How Bad is the VA Claims Backlog?

Backllog

The VA has been underfunded for years. One of the consequences of this funding shortfall is a delay in processing claims. In fact, many people are stuck in VA purgatory, waiting months or even years for a decision by a VA claims processor about whether they can receive benefits.

At Empowerment Legal, PLLC, we sympathize with any member of the veteran community who is patiently waiting for a determination of their claim. Below, we look at the current status of the claims backlog (April 2026) and offer tips on how to expedite the claims process. Call us to speak with an experienced lawyer.

Good News: The Backlog is Shrinking

According to the VA website, the claims backlog has dropped considerably over the past three years. During the pandemic, the number of claims started to rise. And they reached a peak in early 2024, when more than 400,000 claims in the system were waiting at least 125 days for a determination.

Since that highpoint in 2024, the number of backlogged claims has fallen dramatically. In early April 2026, there are only around 81,000 claims waiting at least 125 days for determination. That number is around the lows seen in 2014 and 2015.

In 2024, the VA made considerable progress clearing this backlog, even with around 500,000 new claims submitted each year. This is excellent news for anyone who has applied for VA benefits. With a smaller backlog of cases, you should receive a determination much faster. If you are denied, then you can file an appeal faster. Everyone wins.

How to Speed Up Your Claim

There are certain steps you can take which can minimize the risk of delays:

  • Provide all requested information and supporting documentation upfront. Your claim will not move forward if you are missing certain documents.
  • Fill out the forms accurately and completely. Inaccurate information can delay a claim or possibly even result in a denial.
  • Respond to any request for information or documentation in a prompt manner.
  • Work with a lawyer. An experienced VA benefits lawyer can guide you through the process effectively. We can review an application to identify missing or conflicting information.
  • Don’t delay if your claim is denied. You have the right to an appeal, and you should move quickly.

If you are filing for VA disability benefits, you should continue to receive treatment and follow your doctor’s orders. Those steps will help build up the factual basis for requesting disability.
